Ok my mom just kicked her boyfriend out.
Heres the run down on him:
- owes a lot of people money (including the government)
- low life (basically a rat)
Ya well since he was not aloud a credit card, and has no credit my mom offered to buy a $5000 car for him about 6 months ago. She didn%26#039;t want the car under her name, because he has NO insurance and if something happened she didn%26#039;t want her name to be involved. So she paid for the car on her Visa, and put it under his name. She got him to sign papers saying how he%26#039;d pay he back and stuff, but that seems very unlikely since hes kicked out now.
What can she do to get her money back?
I know about court, but the odds of this guy showing up, and actually paying the sentence after is doubtable.
Any suggestions?

Your mom can take him to court with the papers agreeing to pay for the car and the visa statement showing that she did in fact pay for the car, he will either have to pay her the money for the car, or she%26#039;ll get the car back, which she can in turn sell and hopefully recover all lost money.

My best advice is to have her sue him in small claims court so she can have a judgement issued against him. If she does that she can have them garnish his wages until the debt is paid.|||That was dumb. I know hind site and all. But why? She%26#039;s screwed is what it comes down to, other than the courts. But, under the circumstances, she might as well chalk it up to a bad experience. Better for her to be out the car than it is for her to keep hassling with the guy.
OR.....you can always get hold of Guido and Sarducci.|||Unless she has a written contract between her and her boyfriend, no court will give her money for the car. Without the boyfriend admitting that it was a loan or that he has made payments to her, it will be considered a gift from your mom to him.|||I can only say that your mom should have been smart enough to not put her credit in the line for someone like you described. My ex tried to get me to co-sign for an ATV for him and I WILL NOT put my credit on the line for ANYONE!!|||Judge Judy could make him feel real small, but Judge Mathis will make him feel real shame, for not being man and making way for himself, and mooching off woman|||Court is the only way in such a situation if he doesn%26#039;t voluntarily make the payments....if there is documentation that shows he is in violation of this contract.|||She is out of luck. She could try to take him to court to have his wages garnished but she%26#039;s probably out the money.
Thank GOD that she%26#039;s not on that title because if he%26#039;s as irresponsible as it sounds, she could be in worse trouble.|||It%26#039;s a lesson learned in life. Unless she is recorded as a lienholder on the vehicle, her only recourse may be small claims court.

First of all, she should trade that piece of **** in for something nice for herself. Have that guy present so he will sign the papers to sign over the car. That%26#039;s all, it%26#039;s the only way to get rid of him and not waste time and more money on a pathetic loser. Also sorry your mom had to go through something tough like that. Lucky for her she has a great son like you to count on.

Otherwise, forget it.|||She needs to take him to couort anyway - if he doesn%26#039;t show the judge will decide in your mom%26#039;s favor. A judgement goes on his credit file and tax returns etc can be taken to pay judgements.|||Nothing your mum can do except feel relieve to have kicked the %26#039;rat%26#039; out. You won%26#039;t get a single cent for him as he is so poor to need your mum to feed him in exchange for his companionship. Ask your mum to just forget about him and hope that he won%26#039;t bother her or you anymore in future.|||if she has the papers he signed, she can take him to small claims or civil court. she can also request that the court make him surrender the title to be signed by her as leinholder until the amount is paid. she may also be able to have him pay the court costs. if it were me, I would take him to court and get an order against him, ask the judge for him to surrender the title, sign the lein. then seek a wage withholding order, and if it wasn%26#039;t paid timely (like if he quit his job and couldn%26#039;t be found), I would repossess the car and then take him back to court for the cost of repossession and court costs.
for future reference, it is legal to have a contract to sell a vehicle, sign the car over with you as the leinholder, and have a stipulation in the contract that if it is not paid and repossession is required, the new owner must pay any fees. my mom has done this with a couple of vehicles for friends.|||Well girl with a stupid mother, the only thing your mother can do is take him to court with her proof. Take him to one of those court shows on tv he might get excited and show up. Tell your mother its not a sin to be stupid. Its a sin to stay stupid. Tell her to learn to love herself and she wouldn%26#039;t be so easy to get played. I would have at least put the car in my name so if he would have taken it I could have reported it as stolen. And at least I would have been stuck with a car and a bill. The only thing she got stuck with is a bill. But he seen a weak minded female a mile away. But don%26#039;t worry we%26#039;ve all had our stupid moments even me. I just hope she can get some since before her next relationship. It doesnt matter if he shows up or not. A judgement can still be put against him. The courts then can garnish his wages for the amount that is owed.|||Get someone to whip his butt.|||Tell your Mom to take the $5,000 loss and be done with the bum for good. It was a bad loan, and tell her to get a job and get busy and pay for HER mistake, which is NOT your mistake, even though you may suffer for it. don%26#039;t do that again|||after you take him to court if he doesnt pay up you just file another report on him not paying wahat was ordered by the judge and the police will arrest him|||still take him to court. he will get a bench warrant, and maybe you will not get the money right away but the can start garnishments, or court orders for him to pay, go the legal way.|||I%26#039;m guessing your mom knew he was a lowlife when she bought the car so I think she should just cut her losses. She finally came to her senses and kicked his sorry butt out. She should just chalk this up to experience. Live and learn.
